Terms of Service | Level Up Estimates

1. Acceptance of Terms

By accessing or using the Level Up Estimates platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including contractors, company administrators, and team members.

2. Description of Service

Level Up Estimates provides professional Xactimate estimate writing services for the restoration industry. The Service includes a web portal for job submission, document upload, payment processing, job tracking, messaging, and estimate delivery. Estimates are written by certified Xactimate estimators based on the documentation and information you provide.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

4. Job Submission and Documentation

When you submit a job, you are responsible for providing accurate and complete information about the loss, scope, and claim details. You are also responsible for uploading all relevant documentation including photos, scope sheets, moisture readings, and any other supporting materials. The accuracy of the completed estimate depends on the quality and completeness of the documentation you provide.

5. Payments and Deposits

Deposits are collected at the time of job submission and are non-refundable once estimate production has begun. If production has not started, you may cancel the job for a full refund. Payments are processed securely through our third-party payment processor (Stripe). By providing payment information, you authorize us to charge the applicable deposit amount.

6. Estimate Delivery and Revisions

Estimates are delivered electronically through the portal as ESX and PDF files. Standard turnaround is 3-5 business days. Rush turnaround is available for an additional fee. One round of revisions is included with each job. Additional revisions may be subject to additional charges. Turnaround times are estimates, not guarantees, and may vary based on job complexity and volume.

7. Intellectual Property

Upon delivery and payment in full, you own the completed estimate files. We retain the right to use anonymized, aggregated data for internal analytics and service improvement. All platform software, design, and content (excluding your uploaded documents and delivered estimates) remain the intellectual property of Level Up Estimates.

8. Limitation of Liability

Level Up Estimates provides estimate writing services based on the documentation you supply. We are not an insurance company, adjusting firm, or legal advisor. We do not guarantee that any estimate will be approved by an insurance carrier. Our liability is limited to the amount of the deposit paid for the specific job in question. We are not liable for indirect, incidental, consequential, or punitive damages.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available." We make no warranties, express or implied, regarding the Service, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Indemnification

You agree to indemnify and hold harmless Level Up Estimates, its officers, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may close your account at any time by contacting us. Termination does not relieve you of any payment obligations for jobs already submitted.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the platform or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Texas.
